Corporate Manslaughter
For the first time, since the 6th April, companies and organisations can be found guilty, of the new offence of corporate manslaughter.
An organisation will be guilty of the new offence if the way in which its activities are managed or organised causes a death and amounts to a gross breach of a duty of care to the deceased.
This means an organisation and its management need to think again about how risks are managed and ensure they are taking proper steps to meet current legal duties
SHE Group can help you to do this in a number of ways :-
- Do a business level health and safety audit (which will highlight conformance to the law and where there are non compliances and enable development of an improvement plan).
- Help you with Risk assessment (Paperwork , systems and training)
- Provide training to your staff where required (from management training to specific topic areas).
- Provide professional health and safety advice in the form of a helpdesk service (competent person role)
- Conduct audits
- Help you write or provide policies and procedures
If you can say you have all the above up to date you need do nothing more to comply with this legislation. But remember, if you are not compliant and you are found guilty of the offence the judge may impose an unlimited fine.
Can you afford to do nothing?
